John Murray asked:

There is never a time when you will enjoy being pulled over and receiving speeding tickets. However, there is a good chance that one day you will be exceeding the speed limit and get pulled over. Since that event is likely at some point during your driving career, it would be a good idea to know some facts about what to do when you are getting speeding tickets.

Prior awareness and knowing what to do, when to do it, and what to avoid doing while you are pulled over, will make the experience quicker and less stressful for both you and the police officer. If you see police lights behind you, some things you should know and do are:

1. Pull over onto the right shoulder of the roadway as soon as you can. You should not attempt to pull over on the left shoulder, even if you are in the left hand lane at the time. Pulling over to the right shoulder will put you and the police officer in the safer position. (Hint - a safe police officer is happier and more relaxed! That may be a good thing when receiving speeding tickets, as the officer may decide to be more generous.) Make sure you get as far over on the shoulder as your car can go.

2. When you are driving at night, continue driving to a populated and well lit area, even if you are being pulled over by a marked police car! Gas stations and 24 hour convenience stores are plentiful and a good place to drive to, since they will normally have numerous people around. Most officers will not give you any trouble for doing this, since it keeps all parties involved safer.

3. Have your hands in sight of the police officer at all times. The best place to keep them is right on the steering wheel. The police officer who pulled you over will appreciate this, as it will show him or her clearly that there is not need for aggression. Since the police officer really has no idea who you are when he or she pulls you over, there is no way of knowing you are just an ordinary driver (and not a criminal on the run).

4. Movements while interacting with the officer should be slow and kept to a minimum. What you are reaching for is a mystery to the police officer, so quick movements may cause over-reaction. Inform the police officer what you are reaching for and why.

5. Saying “sir” and “ma’am” every other word when speaking to a police officer after you have been pulled over for speeding tickets won’t get you anywhere! That is basically insulting their intelligence (as they know you are just “buttering them up” when you are saying that) and may cause them to become offended and possibly increase the fine on your citation.

6. Never offer more information than is asked for. If it is a simple question, just answer “yes” or “no”. If it is a more advanced question, keep your answers to the point and as brief as possible. If there is an emergency situation which caused you to speed, let the officer know at once and they can possible give you some assistance.

7. Tell the office what you are doing if you need to retrieve your license and registration from the glove compartment or center console. If they are in the glove box, leave the glove box open. If they are in the center console, take them out and then slowly close the center console door. Closing the center console once you have taken out you documents is important as it will allow the police officer to relax and not worry that you have a gun hidden inside.

8. Don’t ever try to talk your way out of a speeding ticket or argue with the officer at the side of the road. It will just make the officer more irritated and possible increase your fine.

9. Keep your paperwork when you are pulled over for speeding tickets! Items you should keep are:

a. Your copy of the ticket. b. The officer’s car ID number and license plate number c. What kind of radar gun the officer used. Include the make and model. d. A complete personal narrative of all the events - place, time, amount of traffic, officer’s demeanor, what the weather was like…any details you can think of may be helpful later on.

Staying calm, cool and collected when you are pulled over for speeding tickets may get you off with a warning. If you remain cooperative throughout, a kind officer might even let you go on your way without a citation. However, there are some officers that will insist on writing out speeding tickets once they have you pulled over, so stick to the tips on the above list for a quick and less painful experience.

Some Things To Know When You Get Speeding Tickets

Jeremy Thompson asked:

No one likes being pulled over and getting speeding tickets, but chances are that you will at least once during your car driving days. When this unfortunate event occurs, it is best to be prepared ahead of time. Knowing how to act when you are receiving speeding tickets may make the experience a lot less painful and keep you from being charged more due to inappropriate behavior and comments.

Things to know when you are being pulled over for a speeding ticket:

1. Get to the right shoulder as soon as possible. Never pull to the left shoulder, even when in the left hand lane. This will keep you and the officer from being in the path of oncoming traffic, making the experience safer for you both. (A happier officer is a more generous officer when it comes to getting speeding tickets!) Pull as far over onto the right shoulder as is possible.

2. At night, with unmarked police cars (and even marked ones), continue driving to a lighted area. A gas station or all night convenience store is a good place to travel to, as there are other people around. Officers should not have any problems when you do this, as it keeps everyone involved safer.

3. Keep your hands on the steering wheel in plain sight at all times. When the officer arrives at your window to give you the speeding ticket, this shows the officer clearly he has no reason to be aggressive. In reality, this officer has no idea who you are, and even with something as simple as giving a speeding ticket he or she can be taking a big risk.

4. Keep all your movements while you are interacting with the officer to a minimum. The officer may be able to see you are moving, but he or she has no idea what you are going for. State what you are doing and keep your movements slow at all times.

5. Don’t insult the officer’s intelligence by calling him or her “sir” or “ma’am” constantly. The officer will not be flattered or impressed, and this can show on the amount charged on your speeding ticket.

6. Don’t hurt yourself by volunteering incriminating evidence. Answer questions with a “yes” or “no” and keep answers short and too the point. The only time you should expand on speeding is when there is a medical emergency, and in that situation the officer can actually be of assistance.

7. If your license and registration are in your glove compartment, tell the officer that and ask if you can retrieve them. Once you have taken them out, leave the glove compartment open. If it happens to be in the compartment between the front seats, tell the officer that and ask if you can retrieve them. Once you have taken them out, close the center compartment. With the center compartment, the officer may be concerned there is a weapon inside, so closing it can give the officer a more secure feeling while writing out the speeding ticket.

8. Never argue about your speeding tickets on the side of the road. The officer will not listen, as the court will decide if the speeding was justified.

9. Keep paperwork dealing with your speeding tickets! a. A copy of the ticket. b. License plate and ID number of the officer’s car. c. Make and model of the radar gun used. d. A personal account of events, including place, time, weather conditions, amount of traffic, officer’s attitude… whatever detail that you think might be relevant.

If you follow the first several tips on this list, the officer may let you get off with just a warning. By being cooperative, the officer may give you a break. However, if the officer is definitely going to write up the speeding ticket, follow the end of the list to make the experience as quick and easy as possible.

How to Fight a Speeding Ticket

Jason Gadayan asked:

Chances are if you have your license then you have been issued a speeding ticket. For the most part most people think that there is nothing they can do to beat a speeding ticket, because after all if they was speeding that made them break the law. There is a old wise tail that I found to be true a few years back when I receive a speeding ticket for 67mph in a 55mph. The theory was that if the police office did not lock your speed into the radar then you were as free as a bird. The police officer would have no proof to issue you a speeding ticket. I found this to be true. One of the first things you should do when you get pulled over for speeding is to ask the police officer to see the radar and see what speed he had you locked in at. I found that a lot of police officers do not lock the radar after catching someone speeding. Because most people when asked “Do you know why I pulled you over?“ They reply with “Yes I was speeding a little”. Saying that you know why you were pulled over is just the same as saying your are guilty, and the police officer does not have to have your speed lock it at all now. With out this lock there is no way for them to prove you were speeding even if you were speeding. So more than likely that without your speed being locked it will just get thrown out of court (if it goes that far)

There are many other ways to get of a speeding ticket that I found may be very useful. The first thing you are “NOT” to do is say you were speeding and plead guilty. In the USA there there is a saying that people use all the time, “innocent until proven guilty“, so let them do there job and prove it. Do not get angry or start arguing with the police officer. This may irritate the officer and they may issue you speeding ticket. The best approach I can suggest is to ask the officer the reason you were pulled over and be very polite. Hey even being nice and kind with no smart comments can even get you out of a speeding ticket sometimes. The police officer has a great deal of discretion and can just decide to issue you a warning in lieu of a speeding ticket. Again do not admit to the officer that you know why you were pulled over and ‘Don’t argue and get nasty “. There is no point in admitting guilt at this point. OK, lets say your speed was locked into the radar and it was recorded on paper and the officer has decided to issue you a speeding ticket. Now you have to go to a court hearing to find out what your fine is. You’re thinking that there is no way out of it at all. That is where you are wrong. The first thing to do is call for as many continuances as you can. This is when you are unable to make it to the court hearing due to being sick, out of town, or not able to get off work. The longer you can hold off the court the more likely you are going to get out of the ticket.

Now you’re still are going to have to go to court sooner or later, but there is still a way out. The longer you can hold off court the more likely the police officer that pulled you over will not be able to make it to the court hearing. Without the same police officer that issued you the speeding ticket being there in person to give the judge his sworn statement, the court has has no witness to the traffic ticket incident. See this is how it works. When the police officer writes you the ticket when you get pulled over, he bases the court date around his schedule. That way he is able to make it to court. With you calling for a continuance, this throws his schedule off and more than likely he is not going to be able to make it, and I don’t think he is going to make it a point to change his schedule around just to go to a boring court hearing.

Now there is another way to get out of a speeding ticket, and that is to not get a speeding ticket at all. Avoiding a speeding ticket is the 100% way to getting out of a speeding ticket. There is a few tricks to help improve your chances of not even getting pulled over. A good way to help avoid a speeding ticket is to know how many points you have left on your license. Trust me if you are about to loose your license with one more traffic violation and you know it, then you are going be extra careful when driving. In turn this is going to heighten your senses and make you a better and more safer driver on the road. There is a rumor out and about. I am sure you have seen police stickers that you can put on your vehicle. The ones that say you support the men in uniform. Yes, well this could be a good way avoid a speeding ticket. If I was a police officer and I was following someone because I was ready to pull them over and I see a sticker on their vehicle that said that they “support me”, I might just let them go. Just as long as they were not speeding way over the limit. This shows the police officer that you support then and he might just may let you go with a warning or not even pulling you over at all. The local PBA’s or FOP’s around the US depend greatly contributions. If one of their officer’s issues a speeding ticket to a person that has contributed to their organization, believe me the police officer will hear about it. They usually think twice about giving speeding tickets to contributors and supporters of their local union.

Scanning the road ahead of you is another big way to avoid getting pulled over for speeding. You have to think like a police officer. Where would you be sitting at? Some places police like to sit and wait for speeding is behind over passes. This is one of those I see you and you don’t see me things. They also and sit at the top of a on ramp to the freeway. By the time you pass he has you speeding. You are expecting to look up and almost behind you for a police car. You have to take use caution where you would think they might be hiding and waiting.

In some cities now they have red light cameras up that are snapping pictures of people speeding and sending the violator a ticket in the mail. There really is no way out of this but to say you were not the one driving it, it was your friend. All that you might attain with this, is the ticket being pushed off to one of your buddies. These cameras can be found on over passes on the freeways, street corners, and stop lights. They are even found by school zones. There is a product out on the market that you spray on your license plate and then when the camera snaps a picture of your car, the license plate is blurred out and in turn there is no ticket. I have never used this so do your own investigation and use at your own risk.

NOTE: This article is not a 100% way to get out of a speeding ticket. It just simply states what might happen in the event of getting pulled over by a police officer.
